1. Acceptance of Terms

By accessing, browsing, or using the NextWalkin platform (website and mobile applications), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and NextWalkin. If you do not agree with any part of these terms, you must immediately stop using our services. We reserve the right to modify these terms at any time — continued use after changes constitutes acceptance of the updated terms. We will notify registered users of material changes via email.

2. Eligibility & Account Registration

Eligibility Requirements

You must be at least 18 years of age to use NextWalkin. By creating an account, you represent that you are of legal age and have the legal capacity to enter into this agreement. If you are using our platform on behalf of a company or organization, you represent that you have authority to bind that entity to these terms.

Account Responsibilities

You agree to provide accurate, current, and complete information during registration and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must use a strong password and enable two-factor authentication when available. Notify us immediately at nextwalkinofficial@gmail.com if you suspect unauthorized access. Creating multiple accounts, fake profiles, or impersonating others is strictly prohibited and grounds for immediate termination.

3. Terms for Job Seekers

Profile & Application Accuracy

All information in your profile, resume, and job applications must be truthful and accurate. Misrepresenting qualifications, experience, education, or skills is prohibited and may result in account suspension. You are responsible for ensuring your profile is up-to-date and reflects your current qualifications.

Professional Conduct

When attending walk-in interviews facilitated through our platform, you agree to conduct yourself professionally, arrive at the specified venue on time, treat employer representatives with respect, follow the dress code and requirements specified in the listing, and not engage in any disruptive or inappropriate behavior that reflects poorly on the NextWalkin community.

4. Terms for Employers

Job Posting Requirements

All job postings must represent genuine, currently available positions at your organization. Job descriptions must be accurate, complete, and not misleading. Walk-in interview details (date, time, venue address) must be precise and current. You must have proper authorization to post jobs on behalf of your company. Posting fake, expired, or misleading job listings is strictly prohibited and will result in account termination.

Candidate Treatment

Employers agree to treat all candidates with dignity and professionalism, comply with all applicable equal employment opportunity and anti-discrimination laws (including the Equal Remuneration Act, 1976 and the Rights of Persons with Disabilities Act, 2016), not discriminate based on caste, religion, gender, age, disability, or any other protected characteristic, provide timely and transparent communication regarding application status, and ensure safe and respectful interview environments.

Data Usage

Candidate data accessed through NextWalkin may only be used for recruitment purposes related to the posted position. Sharing, selling, or misusing candidate data for any other purpose including unsolicited marketing is prohibited and may result in legal action.

5. Prohibited Activities

You agree not to: (a) Use the platform for any illegal, fraudulent, or unauthorized purpose; (b) Post or transmit harmful, threatening, abusive, defamatory, or discriminatory content; (c) Attempt to gain unauthorized access to any part of the platform or its systems; (d) Use automated tools, bots, or scrapers to extract data from the platform; (e) Interfere with or disrupt the platform's infrastructure or other users' experience; (f) Circumvent any security measures, access controls, or rate limits; (g) Collect or harvest personal information of other users without consent; (h) Post spam, chain letters, pyramid schemes, or misleading content; (i) Use the platform to send unsolicited commercial communications; (j) Sublicense, resell, or commercially exploit any part of the platform without written permission.

6. Intellectual Property

Our Intellectual Property

The NextWalkin platform, including its design, logos, text, graphics, software code, algorithms, features, and all content created by NextWalkin, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of our platform without explicit written permission.

Your Content

You retain ownership of content you upload (resumes, profiles, job listings). By posting content on NextWalkin, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the platform for the purpose of providing our services. You can revoke this license by deleting your content or account.

7. Payments & Subscriptions

Certain features of NextWalkin may require a paid subscription. By subscribing to a paid plan, you agree to pay all applicable fees as described at the time of purchase. Subscription fees are billed in advance on a recurring basis (monthly or annually). You can cancel your subscription at any time through your account settings — cancellation takes effect at the end of the current billing period. Refunds are provided in cases of service unavailability exceeding 48 hours, duplicate charges, or within the first 7 days of a new subscription (subject to review). All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated.

8. Disclaimers & Limitation of Liability

Platform Provided "As Is"

NextWalkin is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, availability, or fitness for a particular purpose of our platform. We do not guarantee that any job listing will result in employment, that any candidate will be suitable for a position, or that the platform will be uninterrupted or error-free.

Limitation of Liability

To the maximum extent permitted by Indian law, NextWalkin shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim related to our services shall not exceed the amount you paid to us in the 12 months preceding the claim. This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).

9. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms of Service, engage in prohibited activities, provide false or misleading information, fail to pay applicable subscription fees, or if required by law or regulation. You may also terminate your account at any time through your account settings. Upon termination, your right to use the platform ceases immediately. Provisions relating to intellectual property, limitation of liability, and dispute resolution shall survive termination.

10. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and the Indian Contract Act, 1872. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts in Greater Noida, Uttar Pradesh, India. Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for at least 30 days. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.
